Intangible Cultural heritage (hereinafter referred to as ICH) is defined as the practices, representations, expressions, knowledge, skills – as well as the instruments, objects, artefacts and cultural spaces associated therewith – that communities, groups and, in some cases, individuals recognize as part of their cultural heritage. As an important manifestation of human intelligence achievements, includes many projects with exclusive characteristics. They have inevitable and intimate connection with modern intellectual property law system in the process of naturally enjoying and actively seeking modern law guarantee. Safeguarding intellectual property rights, so to speak, is one of the most important methods of protecting ICH, and also a good way to involve ICH projects in modern society and inherit and develop them with the help of law. However, at the moment, there are many issues to be solved in the convergence of ICH and intellectual property protection system.
